This “Privacy Policy” explains how Tix59 (“Company,” “we,” “us”) collects, uses, discloses, and otherwise processes personal data on behalf of our customers—typically, merchants (any, a “Merchant”)—in connection with our application, Tix59, which runs on the Clover Point of Sale system (“Clover POS”). Tix59 provides ticketing, event sales, access control, and attendee check-in functionality for Merchants. This Privacy Policy does not apply to Company’s privacy practices in any other context.

Company’s processing of personal data in connection with our application is governed by this Privacy Policy and our agreements with Merchants. In the event of any conflict between this Privacy Policy and a customer agreement, the customer agreement will control to the extent permitted by applicable law.

This Privacy Policy is not a substitute for any privacy policy that a Merchant may be required to provide to their customers, personnel, or other individuals.


Information Clover collects

We may collect personal data from or on behalf of Merchants. Merchants determine the scope of the personal data transferred to us or that we collect, and the information we receive may vary by Merchant. Typically, the information we collect on behalf of Merchants includes:

Information collected when a customer makes a payment

When a customer makes a payment via a Clover POS, we collect information about the transaction, which may include personal data. Transaction information may include the payment card used (tokenized as required by Clover), name associated with the payment card, the Merchant’s store location, date and time of the transaction, transaction amount, and information about the goods or services purchased.

In addition, we collect: transaction identifiers; order, ticket, and event identifiers; line-item details; taxes and fees; discounts or promotions; and payment status (e.g., approved, declined, refunded) as necessary to process payments, issue tickets, generate receipts, reconcile transactions, and support refunds or disputes.

Additional information provided by customers ancillary to payment

We may collect additional information ancillary to the payment, including:

  • Email address or phone number (e.g., for electronic receipts, ticket delivery, or event notifications)

  • Marketing preferences (e.g., opt-in to receive event updates or newsletters)

  • Loyalty or membership information (if the Merchant operates a program)

  • Physical address (if required for delivery or billing)

  • Other information the customer provides, such as birthdate (e.g., age-restricted events), interests or preferences, reviews, and feedback

In addition, we collect: event-specific data such as ticket type, seating/zone, barcode or QR code, attendee name, entry or check-in status, time of entry/exit, re-entry permissions, and other access-control attributes required to deliver ticketing, admissions, and attendance reporting.

Information collected about Merchant personnel

We may collect information about Merchants’ personnel and their interactions with Clover POS and Tix59, such as clock-in/clock-out times and tips earned, user account identifiers, roles and permissions, device identifiers, check-in activity, overrides, refunds, voids, and audit logs necessary for administration, reporting, compliance, and security.

Additional information provided by Merchants about customers or personnel

Merchants may provide additional information directly or via access they grant to us. Customer information may include email addresses, phone numbers, purchase history, event attendance records, ticket usage, seating assignments, and customer account identifiers. Personnel information may include email addresses, phone numbers, shifts, sales history, and role-based access controls or activity logs.


How we use the information we collect

We use personal data for or on behalf of Merchants to provide the services and functionality of our application, including selling and delivering tickets; managing events and orders; generating receipts and reports; enabling venue access, scanning, and check-in; preventing duplicate or unauthorized entry; handling refunds, exchanges, and disputes; and providing analytics on sales, attendance, and operations.

We may also use personal data for related internal purposes, including:

  • Providing important updates, feature changes, and security alerts

  • Measuring performance of and improving the application

  • Responding to inquiries, complaints, and customer support requests

In addition, Company may use personal data as necessary or appropriate to (a) comply with applicable laws and lawful requests; (b) enforce the terms governing our application; (c) protect rights, privacy, safety, or property; and (d) prevent, investigate, and deter fraudulent, harmful, unauthorized, or illegal activity (including ticket fraud, duplicate entry, and abuse of access privileges).


How we share information

We may share personal data with:

  • The Merchant from whom or on whose behalf we collected the data

  • Clover, the platform on which our application runs (see Clover’s Privacy Notice: https://www.clover.com/privacy-policy)

  • Third parties as directed by the Merchant (e.g., event partners or fulfillment services)

  • Service providers that help us operate, secure, and improve the application (e.g., hosting, analytics, support)

  • Company affiliates for the purposes described in this Privacy Policy or in our Merchant agreements

We may disclose personal data to government or law enforcement where required by law or as necessary to comply with legal processes, enforce terms, protect rights and safety, and prevent fraud or abuse.

In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, personal data may be transferred as part of the transaction, subject to reasonable efforts to require the recipient to honor this Privacy Policy.

Where applicable law provides rights regarding personal information, individuals should contact the Merchant regarding the Merchant’s use of Tix59. Where Clover is responsible, individuals may contact Clover per its Privacy Notice. Company will assist the Merchant or Clover as applicable, subject to our contracts.

Additional Information for Merchants Located in Europe

Controller

Company acts as a data processor on behalf of the Merchant (the controller). Clover may also act as a controller in certain circumstances (see https://www.clover.com/privacy-policy).

Legal basis for processing

Company processes personal data as directed or permitted by the Merchant. The Merchant is responsible for establishing the legal basis.

Cross-border data transfer

When transferring data outside the EEA/UK to countries without an adequacy decision, we rely on appropriate safeguards (e.g., Standard Contractual Clauses, Binding Corporate Rules, consent, or other lawful mechanisms).

Data retention

Subject to Merchant agreements, data is retained only as long as necessary to provide services, comply with law, resolve disputes, and enforce agreements.

Data subject rights

EU/UK data subjects should direct requests to the relevant Controller (Merchant).


Your California privacy rights

We do not sell personal information as defined by the CCPA.
In the preceding twelve (12) months, we have not sold any personal information.
